Stylish Emporium – Terms & Conditions

These Terms & Conditions (“Terms”) govern all purchases, services, and interactions with Stylish Emporium (“we”, “us”, “our”). By accessing our website, placing an order, or engaging with our boutique, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

 

1. Definitions

  • “Client” / “Customer” refers to any individual or entity purchasing products or services from Stylish Emporium.
  • “Custom Order” refers to any made‑to‑measure, bespoke, or altered garment created specifically for the client.
  • “Ready‑to‑Wear” refers to standard‑sized garments available for immediate purchase.
  • “Website” refers to www.stylishemporium.co.za and any associated digital platforms.

 

2. Product Information & Availability

  • All product descriptions, images, and pricing are provided in good faith. Minor variations in colour, texture, or fit may occur due to fabric characteristics, lighting, or device display settings.
  • Product availability is not guaranteed. We reserve the right to discontinue or modify any product at any time without prior notice.
  • Prices are subject to change at our discretion. Price changes do not affect confirmed orders.

 

3. Orders, Acceptance & Payment

  • An order is deemed accepted only once full payment or the required deposit has been received.
  • We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, incorrect pricing, or stock unavailability.
  • Payment must be made using approved methods communicated on our website or in-store.
  • All payments must clear before production or dispatch begins.

 

4. Deposits & Custom Orders

  • Custom Orders require a 50% non‑refundable deposit before any work commences.
  • Deposits cover materials, labour, and time allocated to your garment.
  • Once production has begun, no cancellations or refunds will be permitted.
  • Any changes requested after production begins may incur additional charges and may extend the delivery timeline.

 

5. Production Timelines

  • Standard production timelines range from 7–21 working days, depending on complexity and workload.
  • Timelines are estimates and not guaranteed. Delays caused by suppliers, load shedding, or unforeseen circumstances will be communicated.
  • Urgent orders may be accommodated at an additional fee, subject to approval.

 

6. Fittings, Alterations & Client Measurements

  • Clients are responsible for providing accurate measurements when ordering online.
  • In-store measurements are taken with professional care; however, body fluctuations after the fitting are not our responsibility.
  • Minor alterations are included for Custom Orders.
  • Alterations requested due to weight changes, incorrect measurements provided by the client, or design changes will be billed separately.

 

7. Returns, Exchanges & Refunds

Ready‑to‑Wear Items

  • Exchanges are accepted within 7 days of purchase, subject to the following conditions:
    • Item is unworn, unwashed, and in original condition
    • Tags are attached
    • Proof of purchase is provided
  • No cash refunds. Exchanges or store credit only.
  • Items purchased on sale or promotion are final sale and cannot be exchanged.

Custom / Made‑to‑Measure Items

  • Custom Orders are non‑returnable, non‑exchangeable, and non‑refundable under any circumstances, as they are created specifically for the client.

 

8. Cancellations

  • Ready‑to‑Wear orders may be cancelled before dispatch.
  • Custom Orders cannot be cancelled once materials have been purchased or production has begun.
  • If a cancellation is approved at our discretion, any costs incurred will be deducted from the refund or deposit.

 

9. Shipping, Delivery & Collection

  • Clients will be notified when their order is ready for collection or dispatch.
  • Shipping fees are non‑refundable.
  • Delivery timelines provided by couriers are estimates and not guaranteed.
  • Stylish Emporium is not liable for delays, loss, or damage caused by third‑party couriers or incorrect delivery information provided by the client.

 

10. Care Instructions

  • Stylish Emporium is not responsible for damage caused by improper washing, ironing, or handling.
  • Luxury fabrics require delicate care; failure to follow instructions voids any claims.

 

11. Limitation of Liability

  • To the fullest extent permitted by law, Stylish Emporium is not liable for:
    • Allergic reactions or sensitivities to fabrics
    • Wear‑and‑tear resulting from normal use
    • Damage caused by misuse, negligence, or failure to follow care instructions
  • Our total liability for any claim shall not exceed the amount paid for the specific product or service in question.

 

12. Privacy & Data Protection

  • Personal information is collected solely for order processing, communication, and customer service.
  • We do not sell, rent, or share personal data with third parties except where required for order fulfilment or by law.
  • By using our website, you consent to our Privacy Policy.

 

13. Intellectual Property

  • All designs, images, branding, logos, and content associated with Stylish Emporium are protected by copyright and intellectual property laws.
  • No content may be copied, reproduced, or distributed without our written consent.

 

14. Website Use

  • You may not use our website for unlawful, fraudulent, or harmful purposes.
  • We reserve the right to restrict access to any user who violates these Terms.

 

15. Governing Law

  • These Terms are governed by the laws of the Republic of South Africa.
  • Any disputes shall be resolved exclusively in South African courts.

  • Stylish Emporium reserves the right to update or amend these Terms at any time.
  • Changes take effect immediately upon posting on our website.
  • Continued use of our services constitutes acceptance of the updated Terms.
